Docpoint, Inc., a Texas Corporation, producer of Docpoint.com (referred herein after as "Docpoint,") being referred to as "we," "us," or "our” throughout this Privacy Notice, is committed to maintaining the privacy rights of its customers and visitors to our websites. You” or “Your” shall refer to any person, party or company using or accessing our Websites.

Docpoint takes your privacy seriously, and will maintain information about you, your business, your customers, and your users in strict confidence. Please read the following to learn more about our privacy policy, (the "Policy") which describes how we treat your personal information when you use any website owned, monitored and operated by Docpoint’ websites ("Websites"). We created this Privacy Policy ("Privacy Policy") for our Websites to give you confidence as you visit and use our Websites, and to demonstrate our commitment to fair information practices and the protection of privacy. This Privacy Policy is only applicable to our Websites, and not to any other websites that you may be able to access from our Websites including any third party websites with posted links on our websites. This Privacy Policy and the Terms of Use shall govern your use of our websites. Docpoint’ reserves the right to modify this Privacy Policy from time to time, as determined by Docpoint.

i.What This Privacy Policy Covers

This privacy policy covers Docpoint' treatment of personal identifiable information that Docpoint obtains when you are on our sites and when you use our services. This policy does not apply to the practices of companies that Docpoint does not own or control or to people that Docpoint does not employ or manage including any third parties whose websites are posted as links on our Websites.

ii.Registration

Customers are asked to provide certain personal information when they register for our services, such as, their name, address, telephone number and billing information. The personal information received from customers during the registration process is used to manage each Member's account. This information is not shared with third parties, unless specifically stated otherwise in this Privacy Policy or Terms of Use or any other agreement between you and us or in special circumstances. However, in certain situations , Docpoint and a third party partner have agreed to jointly promote certain services so Docpoint, as a result of that common relationship, may provide to that third party partner certain personal information of yours. The personal information that may be shared could include your name, your address and usernames of persons who subscribed to services that are related to the joint promotion by and between Docpoint and its third party partner. The personal information that will be shared will be for the sole purpose of allowing Docpoint and its third party partner to assess results of the promotion. In a joint promotion relationship, the third party partner will use your personal information for the purpose of assessing the results of that promotion.

iii.Information Collection and User

Docpoint automatically tracks and records certain information on our server logs when you visit our Websites, such as, the browser you are using, your IP address, the pages you requested, and other information associated with the interaction of your browser and our Websites (collectively "Traffic Data"). Docpoint does share your personal identifiable information with the businesses and companies that you have schedule reservations. All the information that we compile from our Websites including your personal information is considered confidential.

i.Docpoint Use of Your Contact Information

We may use your contact information and/or data to send you information about Docpoint or our products or Services or to contact you when necessary, including to remind you of upcoming or follow-up appointments or for transactional or administrative purposes, such as, notifying you of major Website changes or for customer service purposes. We will not use your email address or other contact information for commercial or marketing purposes without your consent, except as part of a specific program or feature for which you will have the ability to opt-in or opt-out of.

ii.Information about security

Docpoint follows generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive the information. The services and Websites that we sponsor have security measures in place to protect the loss, misuse, and alteration of the information that is under our control. While we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from illegally obtaining your information. For transactions involving credit or debit cards, users should use secure socket layer (SSL) encryption to protect the transmission of credit or debit card information through our Websites. Except for the SSL transmissions, the Websites are not encrypted. However, access to your user data is restricted by your password.

Your emails to us are not necessarily secure against interception and you should not include sensitive information in those emails. We generally will not ask for your credit or debit card number, password, or other sensitive information in an email and you should assume that if you get such a request, it might be fraudulent. If we become aware that your personal information has been disclosed in a manner not in accordance with this Privacy Policy, we will use reasonable efforts to notify you of the nature and extent of the disclosure, to the extent we know, as soon as reasonably possible and as permitted by law.

iii.Special circumstances

We will keep your personal information private and will not share it with third parties, subject to the following exceptions: (i) when we are required by law and we in the good-faith believe that such action is necessary in order to conform to the law; or (ii) we must comply with a legal process for which our Website has been served. We may also need to give or disclose your personal information to one of our partners, if that partner requires it, but these situations are rare and we will always ask for your explicit permission, in such situations, before disclosing your personal information.

iv.Note About Children's Privacy Issues

Docpoint’ intended audience is for adults, over the age of 17, who are looking to schedule reservations with service or resource providers. For that reason, when you register, we will ask you to confirm that you are over the age of 17. We have no intention of collecting personal information from children or persons who are under the age of 17. Any use of our Websites by children or persons who are under the age of 17 should only be conducted under the supervision of that person’s parent or legal guardian.

v.Information Provided on Behalf of Children

Protecting children's privacy is especially important to us. It is our policy to comply with the Children's Online Privacy Protection Act of 1998 and all other applicable laws.

Docpoint does not collect information from children under the age of 13 in accordance with the Children's Online Privacy Protection Act ("COPPA"). COPPA severely restricts what information can be collected from children under the age of 13. For this reason, children under the age of 13 in the United States are prohibited from using our Websites. Our Websites are not directed to or intended for children’s use, and Docpoint does not knowingly collect any information from individuals under the age of 13. If we learn that we have received any information from an individual under the age of 13, we will use that information only to respond directly to that child, or their parent or legal guardian, to inform him or her that he or she cannot use the services and subsequently we will delete their information from our own servers.

vi.Storage

We store all Traffic Data and review postings indefinitely, even after "deletion," and may archive such information elsewhere. We store all personal information until you request that we modify or delete the information.

vii.Doctors and Dentists

Doctors, dentists, their employees, and their agents should be particularly aware of their obligations of patient confidentiality, including without limitation their obligations under the Health Insurance Portability and Accountability Act ("HIPAA"), both in communicating with Docpoint and in responding to a review of their services posted on our Websites. Docpoint does not have, and will not accept, any obligations of confidentiality with respect to any communications other than those expressly stated in this Privacy Policy and the Terms of Use.

viii.Lost or Stolen Information

You must promptly notify us if your Contact Data is lost, stolen, or used without permission. In such an event, we will remove that Contact Data from your account and update our records accordingly.

ix.How to Access or Modify Your Information

As a registered user of our Websites, you can modify some of the personal information you have included in your profile or change your username by logging in and accessing your account. Upon your request, Docpoint will use commercially reasonable efforts to delete your account and the personal information in your profile; however, it may be impossible to remove your account without some residual information being retained by Docpoint.

x.How to Access or Modify Your Information

Docpoint provides customers with the opportunity to access or modify the information that was provided during registration. To access or modify such information go to the "my account" section of the website.

xi.Responses to Email Inquiries

When Visitors or Customers send email inquiries to Docpoint, the return email address is used to answer the email inquiry we receive. Docpoint does not use the return email address for any other purpose and does not share the return email address with any third party.

xii.Voluntary Customer Surveys

We may periodically conduct business customer surveys. We encourage our customers to participate in these surveys because they provide us with important information that helps us to improve the types of services we offer and how we provide them to you. Your personal information and responses will remain strictly confidential, even if a third party conducts the survey. Participation in our customer surveys is voluntary.

xiii.Public Forums

Please be advised that any information you may disclose in our Member Directory, or any other public areas of our websites or the Internet, becomes public information. You should exercise caution when deciding to disclose personal information in these public areas.

xiv.Changes to This Privacy Policy

We reserve the right at any time to change, update or modify this Privacy Policy, in our discretion, in accordance with the provisions in the Terms regarding amendments, including changes that will retroactively apply to data that we already have collected from you. If we make any changes, which we consider to be substantial, we will notify you by posting a notice with that our Privacy Policy has been revised or through notices on our Websites, that we deem appropriate and reasonable.
